Canada’s Divorce Act amendments continue to shape how Ontario courts handle parenting disputes, family violence considerations, and relocation matters. These changes, which came into effect in 2021, represent some of the most significant updates to Canadian divorce law in decades.

Key changes include a shift in terminology from “custody and access” to “decision-making responsibility” and “parenting time,” greater emphasis on the best interests of the child, new provisions addressing family violence, and clearer rules around relocation when one parent wishes to move with a child.

Under the amended Act, courts are required to consider any family violence and its impact on children and on the safety of the affected family members. This applies even when the violence is not directed at the child.
